The Legacy Mountain development is a cabin community in the mountains.  We hope this site will help improve communications among homeowners and provide valuable information.  If you have any suggestions or additions, please let us know by selecting 'Contact Us' on the left side of the screen.
 
DRIVING DIRECTIONS TO LEGACY MOUNTAIN:
     Drive to Fairview, Utah, on US 89.
     When you come to 300 South, turn east toward the mountains.  300 South is also known as Mountainville Highway.
     Follow the Mountainville Highway about 2 miles until you come to the large sign which reads Skyline Mountain Resort.  There is also a sign which reads Legacy Mountain.
     Turn into the resort and head east toward the mountains on the Upper Gate road.  Drive about a half mile and turn left when the road forks.
     You will need a card key to open the gate. (Purchase through Skyline Mountain Resort office if you're a member.)
     Drive through the gate and immediately turn right onto Birch Creek Road, heading east.
     Follow Birch Creek Road about a mile until you see a sign which points to the left for Legacy Mountain.  Take a sharp left and follow the road.  There is a sign for Legacy Mountain so you know you’re in the right place.  The parking lot for Legacy Mountain is on your left before the snow gate, a dark red-brick colored gate which is open during the warm season. We have an upper and lower parking lot. The upper lot is typically for parking snow going vehicles that will be left there for the entire winter season. The lower lot is for cars and trucks that you do not want to take on the mountain. Custom Legacy Mountain parking tags must be posted in each vehicle when left in either lot. These tags can be purchased from our Treasurer for $3.00 each.
     Go through the snow gate and drive a short distance until the road forks.  Depending on where your property is located on the mountain, make your choice to go either left or right.

Mountain Lions

A few lot owners have recorded or seen mountain lions within the area of Legacy Mountain and Skyline Mountain Resort and expressed concern about dangers associated with wild and predatory animals being in close proximity to cabins and play areas. 
 
The Utah Division of Wildlife Resources (DWR) Biologist assigned to our area (DWR Central Area) is Wes Alexander.  He said the following:
·         Our area is not experiencing a larger-than-normal number of mountain lions this year
·         There have not been any reports of aggressive cats in our area
·         DWR has not had any reported issues with mountain lions in our area
·         Cats will be active when it’s darker, especially during dusk and dawn (when the deer are most active)
·         If anyone experiences an aggressive mountain lion, call and report it to the DWR
·         He wouldn’t hesitate to allow his children to play in the area
·         There has never been a documented fatality of a human by a mountain lion in Utah which has an estimated population of  2,500.

Please keep in mind that there is probably a difference between having a cougar kill in a yard located in the valley and a kill in a mountainous cabin community.
 
According to Wikipedia:
A total of 126 mountain lion attacks, 27 of which were fatal, have been documented in North America in the past 100 years. Fatal cougar attacks are extremely rare and occur much less frequently than fatal snake bites, fatal lightning strikes, or fatal bee stings.  Children are particularly vulnerable. The majority of the child victims were not accompanied by adults.
As with anything else, you have the right to protect yourself, others, or pets who are experiencing an immediate threat.

February 3rd Letter Mailed to All Members

In a series of meetings during the past year, the board of directors of the Legacy Mountain HOA adopted a schedule of fines and penalties for violating the association's Covenants, Conditions, and Restrictions (CC&R's) or the accompanying General Rules.  The CC&R's and the accompanying Rules were adopted by a vote of more than two-thirds of the association lot owners in 2017.  Copies of both documents are posted on the HOA's website at legacymountainhoa.com.
 
The purpose of this letter is to inform al lot owners of the various types of violations that are subject to fine or penalty and the associated amount.  For your information, a copy of the schedule of fines and penalties is enclosed.  The document includes information about the various penalties such as interest charged on unpaid assessments.  The board intends to enforce each type of offense.
 
One violation involves initiating construction or major excavation activities (e.g., installing a driveway) without prior approval of the Architectural Review Committee.  The documents section of the HOA's website includes a detailed list summarizing the restrictions regarding such activities.  Violation of some construction restrictions may also be subject to a fine levied by the Sanpete County Planning and Zoning Department.  Any fines assessed by the County would be above and beyond those assessed by the HOA.
 
The CC&R's and the accompanying General Rules also prohibit lot owners who do not have a cabin from parking a camp trailer, mobile home, or motor home on their lot even for a short period of time.  However, lot owners who have an active building permit issued by Sanpete County are allowed to keep a camp trailer, mobile home or motor home on their lot during the active construction time period as long as they comply with the County's restrictions.
 
The fine schedule also includes fines for violating fire restrictions, igniting fireworks, or shooting a firearm within the boundaries fo the Legacy Mountain development.  The purpose of these restrictions is to minimize danger to life and property and to promote the safety of all lot owners and their guests.
 
Another violation refers to the disposal of unauthorized material in garbage dumpsters provided for the use of all lot owners.  Dumpsters sponsored by the HOA are provided for the disposal of household garbage only.  Construction materials, mattresses, furniture or landscape waste, etc. should not be deposited in these community dumpsters.  Instead, such unauthorized materials should be taken to the County landfill located about 10 miles South of Mt. Pleasant on Highway 89.  Owners engaged in active construction projects are expected to maintain a private dumpster on their lot for depositing construction waste materials.  The remaining fines relate to nuisance restrictions which helps us maintain the serenity and beauty of our mountain community.  We respectfully request your cooperation in abiding by the restrictions specified in the 
CC&R's and General Rules.

Electronic Gate

The card costs are as follows:
 *Cards 1 & 2 are free for new members (only SMR & Legacy Mountain members)
 *Cards 3, 4, & 5 will cost $8.00 + tax
 *Card 6 will cost $20.00 + tax
 *Card 7 will cost $40.00 + tax
 *Card 8 will cost $80.00 + tax
 *Replacement cards will be $8.00 + tax
 *Clickers (remote control) will be available and count as a card and will cost $75.00 + tax
 *Contractor clickers & non-member clickers will cost $200.00 + tax
 *Contractor gate cards will cost $100.00 + tax (they need to check in every 3 months to stay active)

Upcoming Events
The Annual Meeting of the HOA Members
Saturday, June 22nd
The annual meeting will be held on Saturday, June 22, 2024 at the Fairview City Park Pavilion located at 85 South 500 East, Fairview, Utah. The luncheon will begin at 12:00 noon followed by the meeting.
Workdays
Saturday, June 22nd
Workdays this year are scheduled for:
 
Early spring - Impromptu workday to clean out culverts to help with runoff. Members will be notified when this will be done.
 
Saturday, June 22, 2024 - Spray for noxious weeds. More information to come.
 
Saturday, July 13, 2024 - Possibly work in common areas to remove dead wood. More information to come.
 
 

The Snow Gate
The snow gate will open the evening of April 25, 2024. 
 
*Please use caution when roads are wet and muddy. 
 
 

Parking Lot Rules
The HOA provides two parking lots primarily for use during the winter months when owners are unable to drive street vehicles to their cabins.
 
Owners and guests must have an official Legacy Mountain HOA parking tag suspended from their rear view mirror! (A limit of 4 can be purchased from the Treasurer.) Vehicles without a tag will be towed!
 
The upper lot is reserved only for parking off-road vehicles, snow machines, and trailers used to store ATVs and related vehicles for the duration of the winter season.
 
The lower lot is reserved for parking cars and trucks for a few days on a short-term basis.
 
Each trailer and side-by-side cover should be marked with the owners name, lot number and phone number for emergency purposes.
